EXPERT LAWYER ON ENVIRONMENTAL LAW GIVES CONFERENCE ON WATER RIGHTIN BARAHONA

The expert in Politics, Legislation and Environmental Management and the Executive Director of INSAPROMA, Euren Cuevas Medina, gave the conference; Legislative, economic and governance instruments in the integral management of watersheds, within the PRESENTIAL MODALITY OF THE TRAINING PROGRAM FOR THE INTEGRAL MANAGEMENT OF WATER RESOURCES (GIRH – in spanish) in the SOUTH YAQUE HYDROGRAPHIC REGION led by the Pontificia Universidad Católica Madre y Maestra (PUCMM), aimed at southern water system operators. The conference was a remote presentation from Los Angeles by Dr. Solane, Chilean lawyer expert in water law.

Presentación

Casi la totalidad de lo que se comercializa en el mundo tiene como materia prima los recursos naturales, razón por la cual no se puede separar la materia ambiental del comercio. Este diplomado tiene como objetivo dar a conocer los instrumentos, herramientas e instituciones de regulación y control ambiental en el comercio internacional y que los participantes aprendan a usarlas para el manejo y ejercicio adecuado y efectivo de sus respectivas profesiones y lugares de trabajo.

El INSAPROMA con la experiencia acumulada en diplomados anteriores ha detectado la necesidad de impartir este curso en esta materia de Derecho, Medio Ambiente y Comercio, toda vez que los participantes así lo han solicitado, en tal sentido le hemos preparado un contenido en este programa que garantice la motivación suficiente para que los participantes puedan aprender los mecanismos de solución de controversias ambientales en el comercio internacional.

En este diplomado se desarrollan 6 unidades en la que el participante al llegar al término, está en condiciones de sostener discusiones y de ejercer en asuntos que se relacionen con el derecho, medio ambiente y comercio internacional con calidad profesional, por la características del diseño y forma de facilitar el aprendizaje en este curso que se basa en casos prácticos reales y ficticios que se construirán y desarrollarán en clase y fuera del aula.

Presentation

This graduate course has, as its new guide, a class program developed at the Autonomous University of Mexico (UNAM) and shaped by the professor Víctor Amaury Simental Franco in the book “Environmental Law”, published in 2010.

As the laws and cases in Mexico are different from the Dominicans, this program was adapted to the environment and legislation of the country. As you will note, there has been a substantial change in the themes and content of the program, provoked by previous graduate courses that have been developed, in which the need to strengthen the conceptual part throughout the environmental system and in the type of tourism that must be developed in the Dominican Republic to ensure sustainable development.

Environmental Law in the Dominican Republic is very recent, and that is one of the reasons why concepts are still not widely used and sometimes not in the right way, that is why it is necessary to develop more comprehensive and explanatory environmental concepts that are handled at national and international level.

Although the country has one of the most advanced environmental laws in Latin America and the world since year 2000, its application is in its infancy, mainly in the educational mandate, since in its article 56 and subsequent, provide for the compulsory and transversal nature of environmental education at all levels, however, the Dominican State lacks a policy of environmental education that allows Dominicans to know and understand better the functions and importance of preserving the ecosystems.

The Dominican Republic is a country privileged by its natural characteristics that allows them to be of the most coveted destinations in the Caribbean to be visited.

Tourism is considered one of the main lines that contributes most to the gross domestic product of the country, making it a priority for the Dominican government.

Given that tourism is nourished by natural resources, there is a direct relationship with the use of natural resources, it is necessary to ensure that this exploitation is carried out with due controls to ensure sustainable development.

Although the Dominican Republic is eminently touristic because of its natural, cultural, gastronomic and historical conditions, it has not been able to offer or commercialize its potential in a proper way, so that in this graduate course the historical part of tourism, advances and problems will be developed, as well as possible solutions proposed for sustainable tourism.

In this graduate course, 7 units are developed in which the participant, upon reaching the end, is able to hold discussions and exercise law, environmental management and tourism in the Dominican Republic with academic and professional quality, due to the characteristics of the design and way in how to facilitate learning in this course that is based on real and fictitious practical cases that will be built and developed in and outside the classroom.

A mandatory subject in this graduate course is the development of the environmental chapter XVII of the Free Trade Agreement between Central America, Dominican Republic and the United States, whose content strengthens the country’s environmental protection system fundamentally applying the principle of non-regression and institutions and mechanisms Created by this Treaty as the Secretariat for Environmental Affairs, the complaint mechanism and its procedure.

In this graduate course, 7 units are developed in which the participant, upon reaching the end, is able to hold discussions and exercise law, environmental management and tourism in the Dominican Republic with academic and professional quality, due to the characteristics of the design and way in how to facilitate learning in this course that is based on real and fictitious practical cases that will be built and developed in and outside the classroom.

Legal Ombudsman of the Jaragua-Bahoruco-Enriquillo Biosphere Reserve course

El Instituto de Abogados para la Protección del Medio Ambiente (INSAPROMA) con el apoyo de la Procuraduría para la Defensa del Medio Ambiente y los Recursos Naturales, el Grupo Jaragua, el Ministerio de Medio Ambiente y Recursos Naturales a través de la Dirección Provincial de Barahona, la Agencia Española de Cooperación Internacional y Desarrollo (AECID), el Proyecto Araucaria XXI,  la Fundación MacArthur, y  el aval de la Universidad Católica Tecnológica de Barahona (UCATEBA) concluyo satisfactoriamente el día 27 de junio.  El diplomado “Defensoría Legal de la Reserva de Biosfera Jaragua-Bahoruco-Enriquillo.

Este diplomado tuvo como objetivo darle a conocer al capacitando el valor ecológico de la Reserva de Biosfera Jaragua-Bahoruco-Enriquillo, motivar al participante a desarrollar competencias para la aplicación e interpretación efectiva de las herramientas jurídicas ambientales en la Reserva de Biosfera.

El diplomado una duración de 120 horas de las cuales 80 fueron presenciales y 40 se impartieron mediante la plataforma virtual del INSAPROMA www.cursosinsaproma.com. A través de esta plataforma se enviaron las tareas y se mantenía interacción directa entre participantes y profesores con los foros de discusión

Los capacitando estaban compuesto por Jueces, Procuradores, Fiscales, Directores Provinciales Ambientales, Directores de UGAMs, Abogados y miembros de la sociedad civil de las provincias Barahona, Bahoruco, Independencia y Pedernales, con un total de 50 participantes.

Los temas desarrollados fueron:

  • Importancia Ecológica de la Reserva de Biosfera Jaragua-Bahoruco-Enriquill impartido por la Bióloga Yvonne Arias, Directora Ejecutiva del Grupo Jaragua y el Doctor Geógrafo José Ramón Martínez, Responsable de Proyectos en la Agencia Española de Cooperación Internacional para el Desarrollo AECID).
  • Conferencia: Importancia de los Corredores Biológicos dictada por el señor Nicasio Viñas del proyecto Corredor Biológico del Caribe en la República dominicana, la República de Haití y Cuba.
  • Instrumentos Jurídicos Aplicables a la Reserva de Biosfera expuesto por el Lic. José Espinal Beato Procurador para la Defensa del Medio Ambiente.
  • El Derecho Administrativo en Materia Ambiental dado por la Licda. Marlig Desirée Pérez, abogada del Ministerio de Medio Ambiente y Recursos Naturales.
  • Fundamentos del Derecho Ambiental para el Desarrollo Sostenible impartido por el Director de Planificación del Ministerio de Medio Ambiente y Recursos Naturales, Profesor José Rafael Almonte.
  • La Investigación de los Delitos Ambientales tema expuesto por el Magistrado Procurador para la Defensa del Medio Ambiente de Barahona, Dr. Bolivar D`Oleo Montero.
  • El Derecho Civil en materia Ambiental desarrollado por el Lic. Euren Cuevas Medina, Director Ejecutivo del INSAPROMA.
  • La Responsabilidad Penal en materia Ambiental expuesto por el Magistrado Andrés Chalas Velázquez, Procurador General para la Defensa de Medio Ambiente.
  • Procedimiento Penal en Materia Ambiental expuesto por el Lic. José Espinal Beato, Procurador para la Defensa del Medio Ambiente.

Diploma in Law and Environmental Management

Este diplomado es realizado con el aval de la Universidad Autónoma de Santo Domingo (UASD) y tiene como objetivos principales generar en el participante el interés y amor por el cuidado, protección y preservación del medio ambiente y los recursos naturales; así como inducir al capacitando a utilizar de manera idónea las normativas nacionales e internacionales en materia de derecho y gestión ambiental.

Diploma in Legal Ombudsman for the Biosphere Reserve

Objetivos:
a) Que el capacitando conozca el valor ecológico de la Reserva de la Biosfera Jaragua-Bahoruco-Enriquillo para fortalecer su protección.
b) Que el participante desarrolle competencias para la aplicación e interpretación efectiva de las herramientas jurídicas ambientales en la Reserva de la Biosfera Jaragua-Bahoruco-Enriquillo.
