RIGHT AND MANAGEMENT OF THE ENVIRONMENT AND
This graduate course has as its new guide the program and methodology of class developed in the Autonomous University of Mexico (UNAM) and shaped by the professor Victor Amaury Simental Franco in the book “Environmental Law”, edited in 2010. As the laws and cases in Mexico are different from the Dominicans, this program was adapted to the environment and legislation of the country.
As you will note, there has been a substantial change in the themes and content of the program, provoked by previous graduates who have developed, which demonstrated the need to strengthen the conceptual part throughout the environmental system and dramatize the largest number of cases real and fictional as a way to record the content of the program in the minds of people.
Environmental Law in the Dominican Republic is very recent, and that is one of the reasons why concepts are still not widely used and sometimes not in the right way, that is why it is necessary to develop more comprehensive and explanatory environmental concepts that are handled at national and international level.
Although the country has one of the most advanced environmental laws in Latin America and the world since year 2000, its application is in its infancy, mainly in the educational mandate, since in its article 56 and subsequent, provide for the compulsory and transversal nature of environmental education at all levels, however, the Dominican State lacks a policy of environmental education that allows Dominicans to know and understand better the functions and importance of preserving the ecosystems.
A mandatory subject in this graduate course is the development of the environmental chapter XVII of the Free Trade Agreement between Central America, Dominican Republic and the United States, whose content strengthens the country’s environmental protection system fundamentally applying the principle of non-regression and institutions and mechanisms Created by this Treaty as the Secretariat for Environmental Affairs, the complaint mechanism and its procedure.
In this graduate course, 7 units are developed in which the participant, upon reaching the end, is able to hold discussions and exercise law, environmental management and tourism in the Dominican Republic with academic and professional quality, due to the characteristics of the design and way in how to facilitate learning in this course that is based on real and fictitious practical cases that will be built and developed in and outside the classroom.
